Further details have just emerged of British musician Talihah Barnett's ongoing legal battle with Chicago Illinois band, "The Twigs", who currently own the U.S. trademark for "The Twigs".
And as well sounding like a complete creative/branding nightmare, you know that because of all this, right now, someone, somewhere (probably at her indie label) is doing a hella' lot of tricky ADMIN. So, you know...
According to Billboard magazine, the dispute over the name started way back in 2013, when Talihah, then originally known as "Twigs", changed her name to its current form after her offer of $15,000 (so that the two names might co-exist) was rejected by The Twigs, who have been performing under the moniker for two decades.
The band at the time called for a temporary restraining order against the use of the name, and though it was unsuccessful at the time, the band remain within their right to sue again.
FKA's label Beggars Group argued at the time,
"Bands have routinely used derivative names in order to avoid consumer confusion. Dinosaur became Dinosaur Jr Blink became Blink 182 Suede became the London Suede and the Charlatans became the Charlatans UK. Here, FKA Twigs is clearly and easily distinguishable from The Twigs".
And according to Last FM, there are currently 5 artists currently perfoming under the name Twigs... So good luck with that, guys. :-)
